    they cannot tell us what account it has been paid into but certainly how much she should have received. Will get my Mum to call them tomorrow. DWP said that they would look into it further if my Mum says she feels there has been some sort of fraudulent behaviour going on
  • Can I ask what in particular is probate required for in the estate?


    Apologies if I've missed it as I've read the thread a couple of times but cannot see why probate would be needed yet.

    Well I am struggling to work that out too! I think my Mum feels that is required as the other executor (far more educated etc etc than my Mum) has demanded it. He is a friend of the family and has not seen my Nan for many many years so cant see why he wants it. We will continue to look into the matter of the pension as looking at her bank statements, we have no idea where it has gone all these years. The bank statements we have show assets of around 9-10k thats it. She was receiving help with fuel, council tax and rent, leaving only food and rates to pay which the vAunt sorted out from the pension presumably, but as she is being so unhelpful, heaven only knows!!!

    Maybe other executor is thinking that that is what you have to do in all cases. Actually if the value of the estate is low then the banks etc do not require and will hand over the balance of accounts on sight of the will and death certificate. I think they will do this up to values of 15k but it may vary with different banks

    Good chance it(grant) won't be needed if little in the way of assets, but if there is a desire to investigate where all the benifits have been going doing a standard set of enquiries and getting account details going back a few years may uncover something.

    Still need to so the basic equiries to establish what assets there are.

    If there is little or no estate to inherit then probate is not required.

    Many bank release money on sight of the will and death certificate; some below £5000, other as high as £25K.

    If the other executor is insistant, ask them to complete a letter as below as per rob which absolves them of responsibility.

    If the other executor refuses, suggest that you mum advise them that she WILL renounce her executorship and leave it all the the friend to sort out

    I joe bloggs renounce my executorship of the will of (insert nans name) then have them date and sign it.

    Probate will cost around a hundred pounds and it sounds like the estate is not worth much more than this.

    Thanks everyone, you have been really helpful. Just showed my Mum this and she is much calmer realising there is a way of sorting this mess!
  • Is it possible that some DWP payments/benefits are being paid into a second account that your not aware of? It may be in your grandmothers name but the aunt has full control of it?

    There is the possibility that the aunt could of been made an appointee to act on her behalf and may of had the payments directly to her account
