Paypal will still refund if you bought something that didnt arrive. If i buy stuff from hk/china through deal extreme and paypal and the item doesnt work, i do a not received claim, as a not as described dispute paypal wont give a sheet. Technically youve ordered a wiper for 98 meganne and you were never delivered a wiper for a 98 meganne so i would have qualms in opening a dispute for non delivery.0

The DSR is not really about Ebay , in fact if you read the post above you will see what Ebay should be doing in such cases, and not trying to avoid its responsibility IMHO! The DSR is for ALL distance selling...........
In the OP's post the seller is, IMHO probably breaking Ebay rules by asking people to buy outside of Ebay.
Finally if the seller is a business then he will be covered buy the DSR.

It's always a good idea to admit to committing fraud on a public forum.0 -

Except he didn't buy a part for a 98 Megane, he bought a part for a 95 Megane and ASSUMED it would fit his 98 Megane.
I can't see that the seller has done anything wrong.Remember the saying: if it looks too good to be true it almost certainly is.0 -
The seller does not need to do anything wrong
If its a business and it was bought online. phone then dsr stands, the op can change their mind with no reason and expect a refund.
Give Paypal a call and explain to them that you used their system to purchase the item and that the seller is refusing to refund the item under dsr.0 -

No of course it wouldn't but that doesn't change the fact that what you are doing is fraudulent and could result in Paypal taking action against you using your posts on here as evidence.
There is also the point that if you make too many 'not received' claims Paypal will start taking notice and may not assist you when you really need it.0 -

Ebay don't even come into it, as the purchase wasn't made through them.. DSR's apply because the seller was trading as a business.
Ebay think they are above the law anyway.0 -

They haven't. But if they want to distance sell, then they have to abide by distance selling regulations. And the buyer can just change their mind if they want.0
