Smart Parking parking charge - I didn't even use their car park

Hi Everybody
I just got a PCN through post from smart parking ltd dated 22/02/2014 stating my car had staying over free time.
I work in the retail park and knew that they're a !!!!!!! about parking overtime so i never park on their land.
But the nature of the retail park is - there a small council car park at the end and basically you can park there as long as you pleased but unfortunate there are no other way in except drive through the camera operated retail park's carpark.
my only fault was i did turn right into the council car park at no entry sign being desperate about only one spot left or i will be late to work
so their camera 'claimed' that i didnt leave the retail park's carpark but they have a camera pointing to the turning so that shouldnt be problem and they 'should' see where i parked but they still send me a PCN
I read the sticky for newbies and i know i can't ignore this and have to appeal the question is do i used the generic appeal on the sticky or do i appeal on the basis that i didn't use their car park ?
sorry for the mistake and i hope my post is clear - english is not my first language.
Thanks

Hi, welcome to MSE!
Use the generic appeal but add careful wording NOT saying 'I didn't' but saying an extra point that 'the driver did not even park in the retail park so there has been no parking breach at all. There is a small council car park at the end and there is not other way in except to drive through the car park your cameras cover. This is in fact a matter I will complain to the BPA about because you cannot use your cameras to cover a car park entrance where drivers may be using it as a short cut to the Council car park.'
Then check out post #6 in the NEWBIES thread and email Steve Clark the details of this car park (saying nothing about the driver's ''fault'' for using a no entry short cut to the Council car park). Just saying that you are the keeper and have had to appeal to an unfair ticket where the driver did NOT park within the Smart parking site and this site needs investigating due to the Council car park within it. Tell the BPA that there a small unrestricted council car park at the end but unfortunately there are no other ways in except to drive through the camera operated retail park's car park. How can this be an acceptable site for camera enforcement?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you for your reply Coupon-mad. I will start putting my appeal and complain letter to Steve Clark once I came back from work later this afternoon.0
