Hsbc, ppi, fos & ccj

I have a longstanding case with first direct regarding mis-sold PPI, the FOS complaint was registered 23/03/11 and acknowledged by FD, disputing the charges to my account in its final 18 months of operation on the basis that they were levied against an account from which PPI premiums were deducted. FD made 5 separate offers of repayment until they actually managed to come up with the correct sum. I refused on the basis that they didn't remove the demand for charges or the registered default. Now after 5 separate collections companies have harassed me by letter (over 50 letters) and hundreds of phone calls over 2.5years i have now received claim form the county court. I intend to defend on the basis of FD have acknowledged they owe me more than they claim I owe them @£1750 .v. £1524 + court fee. Advice on next steps welcome from knowledgable forum members please. Happy to offer additional detail.

    Good luck with that. The PPI wouldn't have been the reason for default. I don't understand why you didn't accept the offer when it was the right amount.

    OP wanted additional redress in the form of a removal of the default and charges. Since the default and charges were not caused solely by the PPI it's not surprising this was refused.

    I'm also not sure why the OP thinks "harassment" by claims companies has anything to do with his case.

    I think the OP is on collision course with having to pay the other side's court costs.

    To be clear, on numerous occasions the deductions of PPI directly led to O/D charges being levied, i.e going overdrawn by less than the PPI premium, ergo if the PPI premium had not been deducted the account would have remained in credit and no charges applied. I am seeking redress for that. That's why I have not accepted the offer from HSBC. Equally if HSBC had offered the correct sum (total of premiums + statutory interest + refund of errant charges) when first challenged and before the default then clearly I would have accepted. It took 18 months for HSBC to "calulate" the correct refund despite being provided by me, by which time the default had been recorded. Equally, as yet they have not acknowledged the charges issue, hence being with the FOS. I now have an offer of refund greater than the claimed debt, but I'm not sure why I should accept an incorrect offer merely to prevent court action.
