Bank defended - advice required.

Hi all.

I have put in a claim to get back the unlawful charges the bank owes me and they have defended the action. I filed the claim on the moneyclaim website, and in the Particulars of claim I only mentioned a brief outline of the case, because as you know space is limited. I have since read on this website that I should have sent to Northampton a more detailed particulars of claim and sent two copies of this, which I shall now do immediately seen as the back have defended the action.

My question is (1) Do I have to send the two copies to Northampton and then Northampton will send a copy to my bank and keep a copy for the court, or do I have to send the bank a copy personally?

(2) As the claim is going to court I am going to prepare a proper argument (just in case,) and in doing this I want to use my bank statements, articles etc. Does anyone know which court (either Northampton or my local court) that these papers have to be sent to, and also how far in advance of the trial date?

  • Northampton is the central place for Money Claim OnLine(MCOL) which allocate the court where the case is to be heard. Once you do then you need 3 copies, 1 for the court, 1 for the bank and of course 1 for YOU.
    it will be the court where the case is allocated to, usually your local one.

    I'm in a similar position to you, Here's my story so far

    My claim is against BOS i did it on MCOL, and their solicitors put in a Defence stating that my particulars of claim was lacking in any legally recognisable claim against the Defendant. However the named Defence on the papers they sent me were wrong instead of putting BOS as Defendants they put NATWEST!!, So i sent the papers back to their solicitors to amend, and sent a N1 form to MCOL with a N244 with the correct information filled in, but i don't know if they will forward the papers to my local court (I'VE NOT BEEN TRANSFERRED TO ONE AS YET ) or should i ask for the papers back ? so i can send them to my local court when the time comes :confused:

    Their solicitors were only giving me 14 days to remedy the poc which i have not sent them yet as they need to correct the right bank im taking to court first.

  • Thats what i dont understand. Do i send two particulars of claim to Northampton and they will forward a copy to the bank, or, do i send one to Northampton and one to my bank.

  • you send 2 copies to the court when Northampton allocate a court for your case to be heard

  • When i submitted my claim to the court in Banbury i also handed 3 copies of all the corrispondance i had at the time to the court...thats what the lady on the court resseption told me to do, i think its the court the send it all to the relevant people...well since i have submitted the claim Nationwide have said they intend to claim so i take it its all been sent...hope so i had my copy sent back to me ..or do i need 3 more copies for the court hearing date...that would seem a bit strange tho??

    I'm confused cos their solicitors said they would give me 14 days to remedy with the court, but which court ? my local or Northampton ?

    No i have not been transferred to my local court yet, but when i read a post on here it said the the P.O.C should have been sent to Northampton soon after the case was filed on Money Claim's website.
