Losing wtc and ctc as they say I'm not single

Hi all
Just wondering if anyone else has this problem and might be able to help .i recently claimed ppi on my mortgage from when I was married .ive now been divorced for 6 years .i filled in my ex husbands details to process the claim and now the tax credit office claim that I am not single .i have supplied them with a copy of my decree absolute and informed them that my ex has remarried .i also sent in bank statements ,bills ,mortgage etc with my single details but they say this is not proof .now my tax credits have ended and I own them all this years worth of wtc ,close to £9000 along with receiving no more payments .i have done absolutely nothing wrong and am gobsmacked that proof you are divorced isn't considered as the end of the enquiry .i have just sent in further proof of our court order for child maintenance and details of the house transfer .what else can I do ? I'm hoping someone can kindly advise me or may have been in this situation themselves :(

    Proof you have divorced is of course not completely definite - simply as people can get back together.
    Yes - you need to appeal the decision.
    Why did you fill in his details?
  • Appeal this decision - it often takes months to be decided but theTCO often back down when it gets ready to go to tribunal. They are just monumentally inefficient. Don't give up.

    Just appeal. He has remarried and you have divorce papers, presumably you can provide an address of where he lives. Hopefully they will overturn it on appeal.

    You could try putting in a new single application, but they may block it.

    Thanks for all your replies .i only received the letter from them on Friday and tried to speak to them but the person dealing with my case wasn't in .another person there said to send extra details in ,which I have done .maybe I'm being naive but to spend thousands on divorcing and taking out a new 30 year mortgage to stay in the house ,plus the fact he has remarried ,I thought was cast iron proof .they wondered why I have money coming in from him,obviously for child support !
    I'm presuming that I have suddenly received these papers as I've just finished a ppi claim ,so does this show up on my credit record ,despite the fact it is backdated 6 years ? I can't think of another reason ,yet surely they can see what it is for ? I filled in his details as the policy was in joint names and couldn't proceed without it .
    We spilt up 9 years ago and I have had no other relationship since then ,so no ,it is only aimed at his name .
    I've worked hard all this time as a single parent ,retraining in 2 different jobs and I can't actually believe that this can happen .there doesn't seem to be any logic to it .how can you make them believe something that is as obvious as the nose on my face to me ? I feel really let down and worried that I might lose tax credits altogether whereas when I first received the letter I thought it was going to be easy to show them that it was just because I had applied for a ppi refund .

    Though it is rare, people do go through a very costly divorce before getting back together with the same partner.

    Unless you have been explictly told that the belief is that you have ongoing links to your ex, it might be that the timing of the PPI claim is a coincidence and there is a belief that you are with a new partner who is not your ex.


    It would help if you can find out exactly what the tax credit office believes and why. If you portray this enquiry as helping all concerned to clear up a misunderstanding quickly and without straying into irrelevant matters, hopefully they will help you out. It is in nobody's interests for them to pursue an incorrect line of enquiry that you can easily show is incorrect.


    Misleading information finds their way into people's files from time to time. It might be as simple as someone else mistakenly writing down your NI number on a document. However, it is possible your PPI claim has led to some kind of mistaken fresh link to your ex appearing on you credit reference file. Even if the tax credit situation turns out to have nothing to do with your ex, it is worth checking your credit reference files periodically, not least to make sure that they are clear of mistaken links and other incorrect information.
