    If you are asking them to leave you cannot make them pay for the time they are not in residence.
    That would seem a common sense approach, it's what the OP has been asking all along but IMO it's not been definitively answered in this thread yet as the law often doesn't follow common sense.

    There was an earlier point that the tenant cannot claim a refund of rent for the unused part of the rental period but that's a different issue, It may be the tenant is doing a calculation up front in order to pay the correct amount so a refund would not come into it.

    No. It's not. Since you are misusing terms and being legally ambiguous, it is only by understanding the who what why that we can correct your misunderstandings and advise you sensibly.

    So if the term runs from the first of the month till the end of the calender month and the eviction notice given is dated for say the fifteenith if the month, is it right to expect a tenant to pay for the entirerity of the month even though the tennant is resident for half of the month?
    "Eviction Notice"? Not really any such thing, so what do you mean? S21 Notice (which is NOT an 'eviction notice')? Court possession order?.......

    Since you are clearly determined not to answer sensible questions to clarify things, I see no purpose in assisting further.

    clarification isnt going to help. Ive repeated my question several times now. If you dont have an answer thats fine. But dont try to complicate matters.

    Whats the wording at the top of a section 21 then?A little presumptuious to say you have assisted thus far isnt it?
