Hi All,
Question for a friend of mine. Recently opened restaurant branch is not doing as well as expected so they are making redundancies. While some people were let go he was offered move to same position in another restaurant in chain.
He is happy to accept as there is no contract change and travel is the same just slightly different direction.
Question he has is can they make him redundant in new place, start new redundancy process, as since he started 2 weeks back they seem to not have as much work for him as in the old place.

Question is there time, protection time?, during which they can not subject him to another redundancy?0 -
No extra protection.
All he gets is continuity of employment but not much use if he has only just started.
they don't even have to make redundancies for those under 2 years, but it is a lot cleaner for the people that go, claiming JSA no black mark on CV etc.

Ok Thx will pass that on.
Seems a bit of a loop hole for employers? Move someone with redundancy pay to another position and then get rid of them 2 months later presto no pay out?0 -
Statutory redundacy is the same or better if you clock up another years service whatever they do.
Notice may increase also
There is no loop hole it is not a new job it is the same one at a different location.0
