    Car Park Management Services = maybe heard of them once but not known

    Company currently listed as non-trading.
    director Philip Kelley - remember CMS (UK) LTD went into liquidation.
    Philip Kelley is also running Comprehensive Management Services now a member of IPC

    Looks like Parking Control Management have just switched to the Contractual Charge route.

    I've not seen the signs or the "ticket" but their latest appeal rejection letter now states that "the issue is not one of pre-estimation of loss but of contractual agreement". I am seeing if I can get copies of the ticket and signs to see if they match up. Unfortunately the person appealed the "ticket" so I won't have a chance of seeing the NtK.

    Edit: Just seen the "ticket"; it clearly clearly states "Breach: Parked without displaying a valid permit". And the signs mention "failure to comply". Guess they are just confused then ...

    I look forward to seeing the signs. These PPCs are so stupid that they always mess up when trying to go the contractual charge route & the signs usually say something like "By breaching the T&Cs you agree to pay a contractual charge" which is a logical inconsistency as you cannot contract to do something that is forbidden i.e. breach the T&Cs.

    Signs clearly state "Failure to comply with the terms and conditions will result in a £100 parking charge notice".

    Athena ANPR Ltd certainly in their contract with Lidl are attempting to claim the charge is a Contractually agreed sum but it's actually a disguised breach of contract

    Also their rejection letter says "There are sufficient number of signs in the car park, which clearly state that if you fail to comply with the terms you will be liable to pay a parking charge. When you drove into the car park and parked your vehicle, you agreed to the contractual terms detailed on the signage"

    The change of words is because they recently jumped ship from the BPA to the IPC. Their signs haven't caught up yet though!
