Unfair credit card surchages upon buying a car?

    If they agree a refund then according to standard Merchant agreements it should be done by refunding to the same card that the payment was taken from.

    The refund should be entered for the FULL amount of the payment, and the card payment acquirer (usually their bank, but not always) will also refund any charges the business paid directly to them. You get ALL your money back and they get their charges back automatically from the acquirer.

    If the deposit and final payments were made on two different cards then each must be refunded separately onto the card it was taken from.

    If you ask, or agree, to take the refund in a different form then the garage can't reclaim the charges and you'll be out of pocket by the cost to them.

    They have had the car three times and not fixed the fault. So clearly not a quick and easy fix.

    I notice you ignored the second clause in the sentence.

    Thank you so much for you helpful advice. So much better than people pointing out that Freelanders are unreliable or that I should have noticed the fault when I test drove the car.

    I do know you are a little precious about your faulty hairdressers car. Never ever go to landyzone.

    Because it hasn't been correctly diagnosed, therefore it hasn't been fixed. They've attempted to fix it and failed, yes.

    If they keep that up, then it's undeniable that you are owed a refund.

    BUT just because they haven't fixed it in the first couple of attempts doesn't mean it's unfixable. At a wild guess, the first visit revealed a raft of conflicting fault codes. They probably cleared them all, had a good check-over and test drive, found nothing wrong, and handed it back. It happened again, they would have maybe found a fault code pointing them in the general direction, and had a good once-over of all the usual suspects. Next time, they probably dived a bit deeper, maybe changed a sensor or two. It's still there. Next time, I suspect they'll want the car for an extended period in order to

    Sometimes, intermittent faults can be a right PITA to trace and diagnose.

    Very few dealers are outright dishonest. If this problem was so quickly and predictably obvious from a cold start, nobody but a total shark would have released it for sale. The fact that they appear to be taking their SOGA responsibilities seriously suggests they are basically decent and honest people. This, for you, is a good thing.

    I expect if the Freelander had not been used for the 100k miles wandering the streets of surburbia you would be having problems with it now.
