The book has not been removed - it is still available to purchase, albeit at a lower price. Kobo have confirmed that there is an issue with the book itself so that re-downloading is not possible.
Actually she didn't delete it directly, she's got a new phone since so was forced to try & re-download it.
So if your wife still had her old phone she would still have the book?I would just take the credit and buy a new book.0 -

They have confirmed that in all probability there will be the same problem if she tries to just buy & download it again. We have absolutely no interest in any ebooks, which is why we didn't really want to settle for store credit - it's never going to be used and so is a complete waste of the money we spent in the first place.So if your wife still had her old phone she would still have the book?
It's unclear, but from Kobo's message and the error that occurred, it would seem not. She hadn't opened it on the old phone since reading it, but when she downloaded on the new phone it opened right at the end because it remembered where she was, then it insisted the book needed to be closed & reopened for some reason, and it couldn't be reopened. It still doesn't change the fact that she has already read the book though so wouldn't be entitled to a full refund.

Only if WHSmith had gone into the house & taken/destroyed the book & were therefore preventing you from ever accessing it again. We paid for more than a library service. You don't know whether it still works on the old phone, you've already said she didn't delete it but just purchased a new phone. You also haven't tried to download it again to see if it works perfectly well on the new phone.0

Did they take/destroy it from your wifes phone? No.
A more accurate comparison would be buying a book, losing it in some manner and then not being able to buy a replacement because the book is no longer sold.
