letter offer of repayment - advice please

We have an overpayment of £3487. We were going to appeal, but have been advised against it, so we have to pay.

I was going to send this:

Dear Mrs ?

Following your letter of 21st February regarding the overpayment of £x, I would like to make an offer to repayment of £x a week.

This would be added onto the 14-15 bill, which I would like to pay over 52 weeks if possible.

The money would be paid monthly by direct debit,/standing order on the 31st of every month, beginning on 31st March 2014.

Please advise me as soon as possible if this arrangement is acceptable.

Yours etc etc


Does this sound ok? Thank you in advance.

    Have you got any evidence to support how you reached the X pounds per week?

    Are you saying you are going to clear the whole amount in 52 weeks? If so, then they will probably accept it without further information.

    No evidence, its the most we can realistically afford.

    Its going to take us about 4.5 years, but its a guaranteed amount that we can pay and afford. Any more and we'll struggle.

    I would send an Income/Expenditure form with it too so they can see it is a reasonable offer x

    I thought council tax didn't take outgoings into account, just income.

    Could I do a simplified one?

    Income - £x

    Expenditure - £x

    Disposable - £x

    Offer - £x

    So this is council tax? I don't know why I presumed it was tax credits.

    Either way, demonstrating how you got to the figure is a good idea even if it is simplified. When working out how much you can afford to repay they look at income and expenditure, not just income.

    The council tax is in my husband's name. Does he do the income / expenditure form for just him, or the total household?

    I would suggest that you send in evidence of income and expenditure - sounds as though you may have a COuncil Tax Benefit / Council Tax reduction overpayment so if you had an HB one as well, the form you had for that overpayment could be copied to Ctax.

    As you will not clear the full amount, you will likely be taken to court and a liability order granted (CIS knows so much more about this than I) but this should be a formality but will mean additional costs on your account.

    This is a large overpayment, perhaps you could seek advice from a 3rd sector organisation such as CAB to act on your behalf.
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.
