PayPal and Section 75 Consumer Credit Act

Be aware!

If you pay for goods or services by Credit Card via Paypal.

The Credit Card Company will not honour Section 75 because they deem Paypal responsible for the payment as the payment was paid through Paypal.

Paypal has only a 45 day reclaim period so if your claim is over this period you have no claim.

Anyone had this problem or advise.

The credit card company doesnt have any choice over S75 as it is part of legislation.

The problem when it comes to PayPal is that you dont pay the merchant but you pay PayPal to pay the merchant. You DO have S75 but only with whom you paid, so PayPal. If for some reason they never paid the merchant on your behalf then you'd have a valid S75 claim against the transaction.

Whenever you use middlemen like travel agents etc you have very similar problems, it is the person you pay and your contract with them that is protected not the end recipient of the monies
