It is fine as a basis for a likely winner anyway - but you can trust 4consumerrights who is trying to add some specific stuff for you to make your POPLA appeal stronger and relevant to this car park. I have seen an email from 4CR about this car park, earlier today, and I know she's trying to help you, honestly.

Thankyou for your response also - I am more than happy to keep it on forum however I do find your reaction rather strange to say the least -
Especially as it would appear from the posts above that you volunteered idenitifiable information about the case on this open forum and had to be prompted to edit your post.
Firstly, private messages are supposed to be just that - private. I have received many requests off forum for help from people - who do trust me requesting help including compiling court defences and indeed with counterclaim cases. Any private or confidential information exchanged via pm or subsequent emails is kept in strict confidence.
You will note from my first post above that the location here was important and that depending on where this was, the car park could be considered out of the scope of POFA for keeper liability.
Your first pm to me simply gave me a google map of the area - (I am familiar with the area in any case ) and a gargled explanation of where you parked. Hence my second pm to you asking for further clarification - of the exact location parked only, any other details could be redacted.
In fact if the car park is where I think it is - then indeed this could be out of the scope of keeper liability - however this is not 100% sure due to your lack of confirmation. Had you provided this information, then I would have written your POPLA appeal for you by email.
I trusted you enough to provide an email address - so I respectfully request that you now respect my privacy and delete the message containing this.
Regarding your POPLA appeal the following needs amending/improving - so you will need to research these :
Signage not compliant/no contract with driver formed.
Contract with landowner/locus standi
Genuine pre-estimate of loss.
Add also lack of keeper liabilty under POFA as not relevant land.
But you will need to research this and word it so that the onus is put on PE that this site does fall into relevant land.
Please post up a further draft for assessment before submitting and don't miss the deadline. With a little more research and amendments this will succeed.0
