    Any recourse to the small claims court will require you to pay out money first.

    £650-to be honest its not the money its the principal-idon't want their current tenants to have this hassle and Im determined they aren't going to get away with it.

    I agree with the principle so you would need judgment first then see what your options are re recovery, if there is money in the uk say rent or other chattel then you should not be prevented from recovering.

    My small claims is rusty but have a look at the link and see whether you could put the CURRENT rent into a third party debt order.

    just to be clear the father or tenant could owe the landlord money i.e. rent.
    A third party debt order is usually made to stop the defendant taking money out of his or her bank or building society account. The money you are owed is paid to you from the account. A third party debt order can also be sent to anyone who owes the defendant money.
