Iphone 5 and Carphone Warehouse

Hi All,

I have an iphone 5 on contract and purchased with Car Phone Warehouse in Sept 2012.

The lock / unlock button has stopped working making switching the phone on once turned off near impossible.

Apple have tested the phone and have stated that it is a manufacturing issue with the handset which would have been fixed and or replaced by Apple if I would have purchased the handset through them orginally.

I have been researching EU directive 1999/44 and have contacted CPW regarding this but they say they are not governed by the directive and it is Apples responsibilty as they are the manufacturer of the handset which is out of the 1 year manufacturer warranty.

Both companies are saying the other company is responsible. I would be of the understanding that my contract and point of sale was CPW and that they should be taking ownership of situation.

I know some other posts on the forum relate to this problem but can't find one that states which company should take ownership of problem and what the solution should or could be.

Any advice would be greatly appreciated.
