Bankruptcy Process

Hi

Can ayone tell me how long it takes, once forms are filled in for bankruptcy and fees paid, before you go to court.

My son's in a situation where I think the only answer is to go bankrupt but I think he's putting it off. He's been given the money to pay the fees. Whenever we ask him, he says it's in hand ...... I'd just like to know how long it normally takes.

    It depends on your local court - some of them you can go down asap, the next day for eg, others get busier and you have to book an appointment that can be a couple of weeks away.

    The best way to know for sure is to phone up your local Court (you can look on your local Council's website to see if it's listed there, if not at least some sort of Court will be and if you phone them up and tell them you are enquiring about the court that deals with Bankruptcy they should be able to give you the right contact details - that's what I did).

    it depends on the local court being used some you haft to book an appointment for and there could be a waiting list and others you can go anyday before 9.30am and wait ,so you would need to contact the local court for clarification

    All fees and forms are submitted to the court on the day, so if the forms are done and he has the fees then there is no delay there.

    However, getting an appointment for the court is a different matter. At some county courts you can pretty much turn up on the day without an appointment while at others you can have to book many weeks in advance.
    Each court can be different depending on how busy they are, and how they like to work the procedures.

    EDIT: I think that's a consensus.:D

    Also just to say that your son will be asked if hes taken professional advice before the judge will grant the Bankruptcy .

    Hi-somewhere there is a ruling that the Courts 'can not turn you away'-that's what my local Court said. So if you turn up & they say it's booked you can stand your ground & they'll probably see you. Worth a google search!

    Haven`t heard that one but I know some courts have a turn up and wait system wheras others you have to book.

    I suppose its a possibility as most cases are done in minutes and it`s only the paperwork that takes the time.

    Personally I wouldn't do this. Might upset the judge!
  • When i collected my papers (two days ago) i was told they are taking bookings (sounds like a hotel) for v early August at the mo.
    The first time we said hello, was the first time we said goodbye. As the angels took your tiny hand and flew you to the sky-you forever left us breathless. RIP my beautiful granddaughter :(

    If you are in London and are using the Royal Courts of Justice you need to turn up before 10am to be seen on that day.

    We take bookings for our debtors petitions but that is mainly so you dont have to hang round too much. We like to get you before a judge before 10.00am when courts start. It is true that we cant turn you away however we do need a judge to be free so you may find this a prob if you turn up in the afternoon.
