It seems that any referrals for review that the DWP would have sent to ATOS for actioning on or after 20th January will no longer be sent, at the moment. Any in the system before the 20th January will still go ahead.

New claims, any migrations still outstanding from IB/SDA transfers, and any review that the claimant requests will still be processed.

    Lin :)

New claims for ESA will still be assessed tho is my understanding.

Yes, as my post said "new claims, migrations and reviews that the claimant requests" will continue.

However, there are apparently delays with this, and people may have to wait longer for an assessment/decision.

You can tell a lot about a woman by her hands..........for instance, if they are placed around your throat, she's probably slightly upset. ;)
  • I have been in the WRAG since July 2011. I have been through 2 ATOS "medicals" and have been declared fit to work in both, been through 2 tribunals and won both. I realised I put ESA50 returned Aug 2012, should have been Aug 2013. So as far as my case is concerned because form was submitted before 20th Jan, its still going ahead.

Yes. Although there may be delay in hearing from them.

However, assuming you are not on contributory WRAG, with the year cut off rule, it shouldn't affect your payments.

Good news for me. I was placed in the Support Group last April. I was told on my ESA85A I had a "prognosis" of 12 months.

At least I don't have to fill another one of those damn ESA50s out for a while. :)
  • I'd just like to say I get somewhat tired of people blaming ATOS when all they do is follow the orders of the DWP/

It is the DWP with help from the uber ignorant IDS who have created this fiasco, not ATOS.

ATOS have been working up to this sessation for a while, they've said they want out of their contract with the DWP as it is ruining their total business. That business covers a great deal more than working for the UK DWP.

So please, blame the organ grinder not the monkey because otherwise the important thing, the DWP, gets lost in the verbiage
I am not offering advice, at most I describe what I've experienced. My advice is always the same; Talk to a professional face to face.

Debt - None of any type: Bank or any other accounts? - None: Anything in my name? No. Am I being buried in my wife's name... probably
  • I was placed in the WRAG in June last year after going to tribunal. I waited over a year or my appeal to be heard and was told at my first WRAG interview that I was up for 'renewal' in June this year. Does this change mean that I am in the 'after jan 20th group or not'.

Its just that I have heard from a friend who has been on IB for a while that she's now being reassessed ESA and her appointment is for a WCA is in April :(

Transfer from IB to ESA are still going ahead, so your friend will have to go through the process.

Your assessment shouldn't go ahead, as you will be one of the reviews that are 'delayed'.

However, if you are contributory WRAG, and not IR WRAG, you will have to move over to IR (subject to income, savings etc.,) or the payments themselves will stop, under the year cut off rule.
