Nail Varnish return?

Hi everyone
my sister just text me with a problem and I thought this would be the best place to check where she stands!
She bought a nail varnish in Superdrug at the weekend but when she got home and went to put it in the drawer she noticed she already had the exact same one. She took it back in this morning with the receipt hoping to exchange it for another colour. On the receipt it says "we exchange or return within 28 days", but they have refused to let her exchange it even though it's unopened and unused because apparently they do not include cosmetics in this returns policy and nail varnish is classed as a cosmetic.
Where does she stand with this? I could absolutely understand their refusal if it had been opened and THEN she noticed but as it is the item is still packaged as it was when she bought it.

You have no statutory rights to a refund, so it all comes down to the stores conditions for returns, which become part of the contract.
Without knowing the finer details it's hard to give a firm answer but:
1) if the shop have a returns policy which excludes cosmetics, opened or not, then that would apply

I shall tell her she may just have to suck it up then
lucky it isn't an expensive mistake!
She did say that it doesn't note any exclusions on the receipt or signs at the tills, hopefully they will make it a bit clearer.First home purchased 09/08/2013
