I have been told i can no longer receive ESA because my partner works 37 hrs per week, he is not on a massive wage so why cant i still receive it, we are struggling big time now it has been stopped, what do they class as enough for me not to receive it anymore, thanks

    Were you on ESA WRAG contributions based? If he works more than 24 hours a week, you can't receive ESA.

    presuming you were in the WRAG, ESA contributions based only lasts for 1 year. after that you will be assessed for income related ESA.
    if your partner works more than 24 hours a week, you would not be entitled to income based ESA regardless of earnings
    has your condition worsened?
    if so it may be worth having a look at the support group descriptors and as to be reassessed.
    your claim will still be open, even though you are only receiving NI credits.
    if you were to get into the support group, payments could them ne re started

  • What form will i need to fill in to be considered for the support group, i am going to ring this afternoon

    there isnt a form.
    just write a letter and state which descriptor applies to you and enclose evidence to back up your claim.
    it can take a while for them to get back to you and they dont usually acknowledge correspondance.
    id advise to send anything recorded delivery and then to ring every couple of weeks to chase them up

    if you are asking for a review on the basis that your condition has worsened, the onus will be on you to provide evidence that 1) Your condition has worsened since the last decision and 2) you now meet Support Group descriptors.
