New Car not as specification in brochure?

I've just bought a brand new car and in the brochure I was shown it states that it has electrically operated seats for the driver AND the passenger. When I got it home it turns out that it only has an electrically operated seat on the driver's side. The dealer is on my side and is trying to get something sorted out, but the initial response from the manufacturer is 'we can change the spec, read the small print at the back of the brochure'. I've contacted Citizens Advice, but the 'blurb' they have given me seems to relate more to buying something from a shop. Anyone any advice if the dealer can get nowhere with the manufacturer?

I would say speak to the trading standards rather than citizens advice

surely the car is now not as described and it looks like the manufacturer is using the small print as a get out of jail free card

Why does the make and model matter?

It's not a matter of known faults or manufactures recalls, it isn't as described. Whether it's a Kia or a Rolls is irrelevant.

Does the brochure form part of the contract or it it just a guide?

Because it'll allow the rest of us trying to help the opportunity to do some digging and look at the specs, T&Cs, etc for ourselves.

I bet it's a Chevrolet from Motor Depot, as people were ordering them before they had them in stock, have a look on HUKD.

I think the only way you could argue "not as described" would be if you specifically ordered the car because it had passenger side electric seats. Even then it would need to be documented.

Chances are its a new brochure, but your car was built before the spec change.

Of interest, the dealer is being very smart. They're "on your side" and passing the buck to the manufacturer, however you bought the car from the dealer, not the manufacturer, so your beef is with them

    "Described" by who?

Does a brochure which clearly states that spec can change form part of the contract to buy?

brochure is not part of contract, unless you had suitable wording put on the bill of sale. Specs change faster than brochures can be printed. I think you are on a hiding to nothing.
