Late payment markers used instead of default

I had a car finance agreement with Paragon in 2003. I went to live and work abroad. Paragon was advised and the car returned. I was not contacted by Paragon before I left to say there was an outstanding balance on the finance agreement. I returned to the Uk 1 week ago. On my Equifax credit file Paragon has been recording a 6 month late payment marker since 2007. No default is shown. Actually they have just started to register data that says I left my previous property without notifying them of a forwarding address. Reading through the forum I guess that even if there is a debt on this agreement remaining it would be statute barred now since it is 11 years since I had any contact with Paragon. However, no default is registered on my credit file. Does anyone have a standard letter template I can use to start to get this sorted? I need to write to Paragon obviously. Anyone else I need to contact?

  • As you say, no payments or acknowledgement in writing then its statute barred. Providing they never got a CCJ.

    Write to them stating that the account should have defaulted within 6 months of not paying as per ICO guidelines. What they gave done is specifically mentioned in them.

    I would include a printout of the credit entry if you can. Not the rest, just that account.

    If they refuse, refer to FOS. Might take a few months if that is required.
