PIP isn't based on income or anything like that. It's purely awarded because you have care and /or mobility needs. Therefore, you can have your partner over as often as you wish.

PIP gives you the disability premium within WTC. It also means you only need to work 16 hours a week to claim WTC.

PIP by itself doesn't give the disability element of tax credits. It helps you meet part 3 of a 3 part test. The first part is the person with the disability must be the worker and working at least 16 hours a week, the second requirement is that the person must be at a disadvantage in getting a job.

So you need to make sure you meet the disadvantage in getting a job test as well. See http://www.hmrc.gov.uk/taxcredits/tc956.pdf for the criteria.

There is'nt a cap as such, but if that person is staying over often and contributing to your household ie: paying household bills, sharing the food shopping bill, having their mail sent to your address....they could be found to being part of your household. If this person pays mortgage and council tax on another property and also utilitiy bills there should'nt be a problem. Just phone HMRC and explain the situation and get it documented before someone decideds to either report you for 'living together' or the HMRC investigate because some flags up on their systems.

he has nothing at my house apart from overnight bag

he has bills, post, etc all at his own address, I just thought I would ask the question as don't want to be on the wrong side of the law, and no he doesn't contribute to my household, maybe a takeaway now and again, but no more than a girl friend would do
