Private Eye - County Court Claim Form but parking ticket has since been cancelled

I'm hoping you can give me some advice as I've been unable to find similar advice.


I received a parking fine from Parking Eye in October 2013 and after reading wrong advice, I ignored three letters they sent me.


Last week I received a county court claim form saying I owed £165.00 (£100 ticket, £50 solicitors cost and £15 court fees) and I had a limited time to respond.


I went down to the retail park from where I received the parking ticket and I spoke to the manager of one of the shops and she spoke to Parking Eye and cancelled the ticket, due to proof of purchases from that day.


I'm now confused as to what happens now, if the ticket has been cancelled will it still go to court? Will I still have the court fees and solicitors costs to pay? The only way I can see to contact the company about this is through the defence and counterclaim section of the claim form pack?


Any advice would be greatly appreciated, I'm really worried about having to go to court.

    I'm really worried about having to go to court.
    Post on the parking tickets board then, after reading the sticky info thread for ''NEWBIES'' at the top first which I wrote and included a whole section about small claims, most of which emanate from ParkingEye right now:

    and read the PE court claims threads all over pepipoo here, tons of them on every page (nothing to worry about as such, very common over the past year and can be defended). All sorts of different outcomes posted about, many cancelled like yours but the OPs still have to submit a defence just in case:

    ...that forum in particular has loads of ParkingEye court claim threads, helped and defended, and some won. Lots of advice already given, day in day out on pepipoo where I also post as SchoolRunMum. Most cases do NOT go to a hearing but you do have to defend.

    You are not in the Essex, Norfolk, Suffolk or Cambs region are you? Judges there are - allegedly - so fed up with ParkingEye wasting court time, they have stayed all the cases pending one bulk case decision in March.

    If the ticket has been cancelled I expect PE will write and beg you to pay £50, I bet!! If so, reply and say 'if you also pay my wasted costs of £60!'

    By the way you STILL have to submit a defence with pepipoo help you know - or you will LOSE by default thinking the ticket is dead so the claim is cancelled (nope, not over till the fat lady sings and you have it from the Court or PE that the claim is vacated).





    P.S. Glad you got it cancelled but please heed my advice to post on pepipoo and learn about the defence to submit anyway - and be ready for that £50 begging letter. So far your flawed research has led to you:

    - reading old advice from a year ago,
    - ignoring a Letter before County Court Claim,
    - posting on the wrong forum (should have been on the parking ticket board with all the other cases)
    - and calling the Claimant 'Private' Eye(LOL!)

    ...so it's imperative you brush up a bit on the advice and go to the right forum quickly. A bit more attention to what should be done & you could be home and dry.
