                    hi, just joined today and i dont know what to do my head is all over the place, I thought all my problems was over the day i whent bankrupt, I went b/r in feb 06 had no i.v.a or anything and i got an eary discharge in sept o6 just 7 months later , I live with my partner (not married )who i have been with for 20 years we lived in a coucil house at first and 10 years ago he bought this property we have now , i did not go on the morgage at the time as i was in debt then all my life i have never been good with money so he bought it in his name only, then over the years again i ran up debt again ( i do this secretly ) till it got too much out of hand and i broke down and told him how much i owed out, he was gob smacked , we looked into bankrupty and we was more or less told that it would only affect me , but recently he whent to sign for a new car and was rejected ( he has never been refused credit in his life) then he applyed for a credit card refused again. now this morning we both got letters saying that as i contributed into the househld goods and bills that they are seeking possession of 50% of the house , i have brought him nothing but trouble how can they take his house away, why now , why was none of this said before i went bankrupt, i saw a solicitor as well when i went through with it why was this never explaind to me , i would not no way have gone b/r if i new this was going to happen and he woulden't have let me is there anything i can do about this please someone help me , i feel worse now than when i was in so much debt. now i understand why some people do what they do to themselfs when things like this happen as i feel like ending it all at the moment

            Firstly you neeed to find out who the letters are from. They must be from a court or the OR to hold any weight. It sounds like idle threats which are meant to put the wind up you. Please try and stay calm.
 Richie was around earlier but I saw somewhere that he wa sgoing to be offline til Sat morning.
 However, if you PM him and say TJ said to, then you may get a quicker response.
 In the meantime, I`ll try and track him and make him aware of this one in case he`s still around tonight.

            hi, the letter was from Turner Parkinson llp solicitors in Manchester, i went b/r in warrington county court and o/r was from Chester , it says we act on behalf of your trustees in bankruptcy. it says because i have contrubuted to bills and shopping , all his bank statments prove he has paid the morgage on his own we both have been sent letters bythe same solicior but they are worded a bit differently

 First things first, if you end it all at the moment then the O.R will collect on any and all your life insurance / assurance policies so you've got to stop thinking along those lines; you and your partner will get through this as a couple, you'll make his life infinitely worse if he were to lose you.
 The O.R or your Trustee does have the right and or obligation to realise any Beneficial Interest you have in the house and a 50/50 split is the maximum he can get; your position is to negotiate, argue and ultimately agree on a smaller %age.
 THe problem with a forum like this is we can only make observations and offer suggestions based on our own experience, we can research the relevant regulations and case law but we're not experts; we don't have professional training.
 What you need more than anything now is a solicitor or insolvency practitioner who has experience in this aspect of bankruptcy. We can make suggestions and offer advice but the problem is that no two situations are exactly the same and you need somebody on your side who has all the information relating to your case.
 I can try to point you in the right direction and hopefully make sure you ask all the right questions, but even to do that we need more information:
 1. Whose name was the original tenancy agreement in?
 2. Did your partner live for any period of time there before you moved in? (please say "yes" and have some way of proving where you were living)
 3. Do you have any children? Their ages, are they from your current relationship or previous ones?
 4. Do you, or have you ever had any relatives living with you; parents, grandparents?
 5. How much equity is there in the house?
 6. How much surplus income do you have per month?
 I know these questions seem intrusive, and I don't ask them for no good reason, but remember this site is anonymous so it doesn't matter what you information you give.
 There is no magic solution to this problem; you just need to work towards a solution that's acceptable to you and your partner. It might not be an ideal solution but you've got to start focusing on how you can make that solution more acceptable rather than just wishing it would all go away.
 Please bear in mind that you're not going to feel any worse than you do at the moment so the only way is up.
