Obstructive Parking - Parking Eye

Hi,

I have tried to read through as many of the posts as I can to find answers or advice.

We parked a large Luton van at Ikea. As it would not actually fit into a single parking space and parking over 2 in tandem we were concerned we would not get out of the space due to the turning circle we parked diagonally across 2 spaces. All the other spaces around the van were occupied when we got back - to find we had a parking ticket for 'Obstructive Parking'. We challenged the parking operative who said if we had parked in tandem spaces, one in front of the other that would have been OK. Or we could have parked on an end somewhere else in the car park ( we couldn't see any at the time).

So we have appealed, which was rejected. We did not appeal to POPLA in the 28 days as none of their conditions for appeal seemed to fit - yes we were parked in more than 1 parking bay. We did request information on their rules for parking oversized vehicles but no response.

We parked so that there was no rear overhang of the vehicle into the road between parking bays and minimal overhang over the 2 spaces we occupied.

We have now received the 'Letter Before County Court Claim'.
Any advice on how to proceed from here would be much appreciated.

    You need to re-read the Sticky threads at the top of this page. All the in formation you need is there. Come back here for further advice when you have done this.

  • Any letter before claim needs to be responded to robustly within 14 or else court papers can be served. Just a matter of pat-a-cake robustly responding to points raised.

    Very surprised that there was an on site parking attendant here and you state this is Parking Eye - most of their sites are ANPR only.

    You should also be complaining robustly to the retailers here - angry customer mode see successful complaints thread.

    Thats the problem, the so called appeal options put people of, however they are completely irrelevant and you can tick any box you like

    After the event, I know, but why did you not approach IKEA direct? I am assuming you took the van as you were buying furniture nand, if you did, would have had proof of purchase.

    Seems a very simple and obvious thing to have done.
