Can anyone help?

Hello everyone,
I am at the very beginning of this process and I am just seeking some advice. I sent the first template letter to Natwest to request a copy of my original credit card agreement from July 1998 and I received documentation back from them. For some reason i was offrered both a Visa and a Mastercard in 1998. Natwest included a microscopic copy of the credit agreement which is so hard to read I could barely read it with a magnifying glass.
Never the less I could see that I had ticked the boxes for both "Credit card Repayment protection" and a one year "Natwest card Protection" which is curious because I have never had anything insured in my life because I consider the entire insurance industry to be a scam. What also puzzled me was reading this evidence that I had indeed opted for insurance when I had been told twice in the past couple of years that I had categorically not taken out any insurance when I called Natwest card Centre. The thing is its so far back that I cannot remember if I was sold insurance compulsory, but I would never normally go for insurance for anything.
On the original application form I had ticked the box stating my self empolyment status, even though as a freelance musician I am unemployed as much as I am working which is about six months of the year. I looked at my most recent Credit Card statememts and there is no mention of PPI or CPP. Apparently my account "has not been sold". What I want to ask is this...

1. Do I have a case?
2. If so could I claim as far back as July 1998 when I first applied for a Credit Card from Natwest?
3. In terms of the Ombudsmans form should I contact them for a copy or do I just print off the copy on this website?

I do hope someone can help me! All the best Cheers R

The data protection act requires them to supply a copy of what they have but it does not have to be in a consumer friendly matter. Poor printouts etc are very common as that is how they have access to the data (especially on old microfiche film).

However, as it is a credit card, why do you need the credit agreement?

It is quite possible, indeed, probable that the person you spoke to couldn't see any evidence of PPI on their current systems. 1998 microfiche data would not be readily available to the telephone line.
The thing is its so far back that I cannot remember if I was sold insurance compulsory, but I would never normally go for insurance for anything.

i wouldnt worry about that as a complaint reason. Very few complaints succeed with that reason as there is not normally evidence to back up that allegation. They either fail or go on to succeed with a different reason.

So were you either singed on at the job centre (unemployed) of self employed as a freelance musician? you cant be both at the same time.
    1. Do I have a case?

You havent given any real reasons for mis-sale.
    2. If so could I claim as far back as July 1998 when I first applied for a Credit Card from Natwest?

Only if your complaint succeeds and you have evidence of paying it back to 1998.
    3. In terms of the Ombudsmans form should I contact them for a copy or do I just print off the copy on this website?

use the form on this website. Its the same.

Have you actually ever paid PPI? For example, if you have never borrowed on the card then you wouldnt have paid any PPI. Even if it was set up on the account.

  • I have borrowed continuously from both the Visa and MasterCard (for some reason they offered me two credit cards when I signed up in 1998) so I presume I've been paying PPI and perhaps even CPP since 1998.
I have been classed as Self Employed since I left college in 1997 and I pay class 2 NI and am on Schedule D for tax. I was just trying to say that short periods of unemployment are a regular feature in my working life.

You'll need proof of any such payments going back so far. As Dunstonh says, it's possible PPI was added on the account but never paid if you consistently borrowed and then paid off the outstanding amount each month. Do you have any statements from your own archive showing PPI?
You cannot complain on the basis of a "presumption" that you paid PPI (and CPP), you or the Bank must have evidence in order for you to construct a robust and honest complaint.
