PPI Claim for Mortgage

Hi

I had a mortgage in 2001 which I paid off in full after selling the property in 2004. At the time I was married to my ex. Is there a way of knowing if the PPI has already been claimed by her & what to do if it has? Surely I wouldve had to sign a consent form?

I am looking into claiming for the mortgage anyway but wondered what to do if it came back its already been paid out?

What steps would be the correct course of action if I had to take them?

    If it were a joint policy there is no way she would be able to receive any redress without your signature.

    Also, whats wrong with it? it's mortgage PPI and protects the payments on your most expensive possession.

    I assume you mean complain and not claim. A joint policy would require both of you to complain or at least, if a complaint was successful then the proceeds would be split 50/50 between you.

  • The PPI which was on the mortgage was rubbish. When my ex went to hospital & couldnt work they wouldnt pay up. Even though her liability was 30%, mine was 70%.

    The only time we went to use the PPI & it failed us due to small print so effectively it was missold.

    I meant if she had claimed the PPI already without my knowledge. Its as I assumed, it needs both signatures.

    But you know she tried to claim and it was declined.
  • No she tried to use PPI to help paying the mortgage.

    I dont know if she has contacted them to claim the PPI off the mortgage.
    I was enquiring what to do if she has claimed the PPI back.

    MPPI actually gets more complaints rejected than upheld because it is generally a higher quality product.
    When my ex went to hospital & couldnt work they wouldnt pay up.
    MPPI is not a hospital cash plan. So, you shouldnt expect it to pay out on something it doesnt cover.

    That is not grounds for complaint. It would be like saying life assurance is mis-sold because I didnt die.

    In 2001, did you buy via the lender or via a broker?

    No. Effectively you didn't read the terms & conditions properly. You would need a better cause for complaint than that. Also, bearing in kind the dates you have given, if you complain about this then they are likely to time bar you.

    As regards the original question, if it was a joint policy and only she complained, if the complaint was upheld most sellers would only offer her 50% redress. However, I've not heard anything so far to indicate that a complaint would be likely to be upheld.

    Totally irrelevant I am afraid, especially if you brought it via a broker. An advised sale did not exist for them in 2001 and even if they were members of the then voluntary Mortgage Code the only things they had to make clear were optionality and how much it cost.
