  • If it was me I would contact the agency firstly by phone then follow up in writing. I would ask for owner to contact me or at least for agency to talk to them thdn get back to me with what is said

    The agency.

Its one of the benefits of renting through an agency that they are responsible for anything like this. The difficulty is actually getting them to do something! Just hassle them.
  • does that means Agency has to fix it?

No, but it gives you a first port of contact.

Its down to the Landlord to fix it and they may decide to do it via the agency. Or the landlord may decide to ignore it.

Your next step then would probably to issue the landlord with a letter before action, (the legal route)

What is actually the problem, is it an overflowing gutter/ is it blocked/broken?

If the landlord ignores it and its a simple thing to remedy such as a blocked drain/gutter. I would probably deal with it myself - yes its annoying to fix someone elses problem but it may be cheaper in the long term and protects your house.
  • Is it causing similar problems to their house also?
