Egg SAR Advice

Hi there,

I am new to this forum and found some useful information but thought i'd post a new thread and get exact answers to my questions as to get it right first time :-)

I had a loan with Egg Banking Plc back in 2005 and repaid in full 2007. I have full set of original bank statements with Direct Debit references/amounts/loan account number etc.

I know i was mis-sold PPI but have no proof of that, no Egg Loan agreements or similar. I have read in a few threads that i can submit a SAR and attach a 10GBP cheque and have any information they have on my loan sent to me?

My hope is to get the proof i need of PPI mis-selling and submit a PPI claim with the required proof?

Am i approaching this the correct way? Can i make a claim without proof of PPI mis-selling?

Many versions of SAR forms online and some don't seem to do the job as either worded incorrectly or the correct questions not asked in form.

What template should i use? And who do i make the 10GBP cheque payable to?

And who do I send the SAR + cheque to? Canada Square Operations?

    A SAR will only provide information you already have in far more detail in those statements.
    SAR letters are only useful to those who have no documentation of their own.
    SAR letters do not provide "proof" that PPI was mis-sold, they are simply a report of financial information kept on file for you by the Bank.

    There is no point in you sending a SAR letter in your circumstance. It would be a waste of £10.
  • So are you suggesting what I have will suffice in making a claim to Egg for mis-sold PPI?

    I have no docs showing PPI payments.

    How would you suggest I proceed?

    Sorry, thought you were talking about a credit card rather than a loan. Credit card PPI payments show on your statements (which you said you had a complete set of).
    Submit a SAR to Egg to see what records they still have on file for you. As I said earlier,SAR letters do not provide "proof" that PPI was mis-sold, they are simply a report of financial information kept on file for you by the Bank.
    It's possible, nine years on, that records no longer exist for this loan. You'll have to gamble £10 to find out...

    Why do you think you were missold the product? And what sort of "proof" are you hoping to obtain? Bank paperwork is designed to show that the product was sold fairly and compliantly. We know that sometimes sales people stretch the truth but it is very rarely documented that they have done so.
  • No problem Moneyineptitude. What i am hoping to get from a SAR is the agreement from Egg showing the breakdown in monthly monthly payments along with PPI. I have read that you need some kind of proof that you have paid PPI and that your claim will be rejected if not.

    Will a SAR provide an agreement is still on file? If not can i use a spreadsheet to calculate this and show the PPI? Do you know of such a spreadsheet?

    Or should i just go ahead with my claim with just bank statements and PPI form? I don't think i'll stand a chance with just these going by previous attempts detailed in forum.

    That is unlikely to be the case with a loan.

    But what are your complaint reasons. The amount of the premium is not usually a good complaint reason.

    This is not a complaint reason. A complaint about misselling is not about the product itself. It's about the way it was sold, the information/ advice that was provided at the time. So knowing someone else who bought the same product and had a complaint upheld about the way it was sold doesn't mean that you would as well. You need to be able to show that you were misinformed/ misled/ badly advised at the point of sale and wouldn't have bought the product otherwise. So how were you misinformed?

    If they still have the agreement then they will send it in response to a SAR. But that is not likely to help you argue that it was missold.

    All you need to make a complaint is your loan details and complaint reasons.
