Jewellery repair problem

I had a ring repaired about three weeks ago by a local goldsmith. It had snapped on one of the shoulders of the setting but he said he could fix it no problem so I paid him the (IMO) exorbitant £25 and was pleased when I got it back the following week. The problem I have now is that its started to crack in exactly the same place (I noticed it on Monday which would have been about a fortnight after I picked it up). He says that it cant possibly be the same fault and "he doesn't want to call me a liar but its impossible".
I've asked to take it in so he can see it but does he have to fix it, or can he just refuse?

Unless you have a picture of the previous damage, or a reciept of what was done to it, then you really don't. Also, £25 seems a lot for that!
As I work for a jewellers all I could suggest is to get it fixed or valued by a repair company such a Apex, if possible, as they have no hassle re-doing things and giving refunds.

Well I took it in and he's insisting that its an inherant fault in the design of the ring, that the band is too thin for the setting and its putting stress on the shoulder. He wouldnt however agree to thickening the band as the band kinda weaves into the setting and it'd look odd. He did however agree to refixing the break. We'll see how long this one lasts... but if its anything like the first time I wont be taking anything else to him.:A:A:A:A:A:A0
