    See above. As you failed your assessment that means you did not meet the descriptors. Have you not even looked at them, surely you have addressed them in your appeal?

    In previous posts you refer to a husband. If he is still around his income (including any benefits) will be counted towards your claim.
    my husband is not working, i know i did not meet the descriptors in the first assessment, but i am still having pain and treatment for it, i just want to know if i do fail the tribural can i put a new claim in for the same complaint or not, or will i have to make a claim for jsa. it has been 6 months since my first assesment

    Is your doctor willing to give you a fit note? You will need this to be eligible for ESA again.

    There is nothing to stop you claiming ESA again. However given that you know you do not meet the descriptors it would make more sense that you claim JSA and seek suitable work. There is nothing to stop you continuing your treatment whilst seeking work.

    i have already got a sick note in, whats till may, will this be no good if i fail tribural

    i am still in pain and it has got worst since my last assestment, so i won't meet the jsa requirements thats why i am thinking of reclaiming esa, but all this may not matter as i might win my triburial, i just wanted advice on what to do next

    Being in pain is not a bar to claiming JSA, you can explain your limitations to the advisor so you would not be expected to do work that would exacerbate your condition. Thousands of people with back pain do work, can you not think of anything you could do?
