Also when buying Presents I look to buy in advance and then check the item over prior to giving the gift - that way can deal with such an issue. The complaint can quickly be described as 'You sold me a used broken Dvd player', no further narrative is required..

On a slightly different (but relevant) note, a couple of years ago a friend of my wife who worked for a major high street bank made an error and managed to post 2 letters containing sensitive banking information to the wrong customers (put them in the wrong envelopes so each customer received the others details).
The ICO got involved and undertook an investigation which found that the bank had policies and procedures in place which they considered reasonable to prevent such an error occurring and they did not take the complaint any further.
The bank conducted their own investigation and found that although it had been an honest mistake, because the story had appeared on local & social media it had brought the organisation into disrepute and damaged their public image - my wife's friend was immediately sacked on these grounds.0 -
Just get the thing replaced and ask, nicely, for a £10 gift card by way of apology.
Then get on with life.0 -

I quite agree that they shouldn't be selling items that they know are broken, however, people returns items to Argos for 2 reasons: a) because they are faulty, and b) because they don't require the item.
It only takes a mistake by a busy member of staff to put a faulty item in the pile of stock returned under the 16 day returns policy and it will be taken up to the warehouse and restocked.0 -
Have you tried to take it back? Now luckily I live between multiple branches of Argos, but in the past we have taken goods back both because they were not required and because they were faulty. Case in point we returned a big screen TV that could not be stopped from automatically turned off.
In some cases, where we return it is not the branch we purchased from, there must be another Argos somewhere in the 200 miles between you and the branch that sold it.
Surely your first step should be to take it to a local branch, explain the situation and try to get it replaced? Did you do that?April 2008 - Epiphany - At least £28K owed to 5 CC's

I think it's harsh to say the OP is grubbing for compensation but I do think that he is taking it too personally, it's a mistake that should not have happened and the receipt was probably in the bag to be processed as faulty stock on their systems before sending it back to the supplier.
If it was me I'd send a handmade card to my kiddie to make her smile and promise a surprise the next time...
Then return the goods to Argos as per the returns policy and drop the idea of a DPA breach because as others have pointed out it's not his details.
The likelihood is that the kid is just excited to see her daddy, especially as he has a present! She won't want to see her mummy and daddy fighting and certainly won't want her daddy to be angry.
