HELP! Parking Charge Notice -I was driver. still a case?

Hello there everbody,

Firstly, may I commend all those posters on helping strangers out. I am not a very computer-literate type, but browsing through some on the stories on this site is reassuring about human nature & the times we are in.

I wonder if you might be able to advise me on my predicament...
I recently parked in a council owned basement carpark, whilst visiting my friend flat. I parked in their designated space. When I returned to my car, I found the cellophane yellow & black envelope on my windshield, but no ticket.
Immediately I emailed the council explaining that I was concerned about the situation, & informing them that I had parked there with my friend's permission.
5 weeks later I received the postal 'parking charge notice', & this time I appealed to the address on that 'letter'. I mentioned that I was the driver.
They rejected my appeal. Since then I have found this site, &I wonder if I have blown my case as I have admitted being the driver...
If anyone could shed any light on how/on what grounds I would be best to appeal again, I would be most grateful. Or if I have blown it, am I best to pay the charge now, before it goes up...?

    Okay your post is a bit of all over the place, so a few questions

    1) who gave you this ticket exactly?
    2) if you appealed, was it to a council or company?
    3) if a company, was it England or Wales ?

    UK Parking Patrol Office issued the charge.
    I appealed firstly to Manchester City Council (as I didn't know what exactly the ticket was), & then after receiving the postal PCN, I appealed in writing to the UK Parking Patrol Office in Manchester.

    UKPC appeals office are not based in Manchester - where did you get the address from?
  • you cant appeal again to the parking company, but you can appeal to Popla

  • I got the address from the 'Notice to Driver/Keeper/Hirer' : 'Appeals Dept., The UK Parking Patrol Office, Office 309...M34EL'

    The rejection-of-appeal letter from UKPPO did refer to POPLA, and include the code. It rejected the appeal because 'vehicle was on private land signed with contractual notices stating that a valid permit must be on clear display at all times to park'

    * I thought it was a council building as some of the flats are owned by the council, tho I guess I must have got that wrong.

    Date of appeal rejection.

    You need to get your POPLA appeal in within the time frame of 28 days from appeal rejection.

    We have some basic winning POPLA appeals in the Newbies sticky thread to start you off, but if you gave us a bit more detail, I am sure your appeal could be tailored better.

    It says on the rejection-letter that if I 'opt for independent arbitration..and are unsuccessful, the full amount will become payable...'
    Would you say there was a good chance of winning the appeal?

    As for who is or isnt the driver, it matters not one bit if you have said you were the driver, even before the protection of freedoms act came in and it was one of the (still) rare cases to come to court you would run the risk of being outed on the balance of probabilities that you were the driver ( unless you had rock solid evidence otherwise)

    it may be in their eyes, but a POPLA decision is only binding upon the parking company and not the motorist, however it is a good opportunity to get the thing cancelled and out of the way for once and for all.

    Another avenue to go down is to complain to the land owner/whoever contracted the parking company to act as their agents, however as the POPLa clock is ticking you should concentrate on a POPLa challenge, complain to the car park owner as well, but dont loose sight of the POPLA time scales.
    in your intial dealings with the car parking company did you include this form the sticky thread?
    '' My challenge is based on the assertion that your parking charge does not represent a genuine pre-estimate of loss to yourself or the landowner. In every case where a motorist has raised this issue, POPLA have accepted the appeal. You are therefore fully aware that there is no prospect of your charge being upheld.     Depending upon timescales ( you should concentrate on POPLA as the clock is ticking) you may want to edit that and aim it at the car park owner for the car park company are nothing but agents acting for and on behalf of the car park owners - unless you take action to stop your agents ( name of PPC) from continuing then I must inform you that I may claim my expenses from you and........
