Hi there,
I have just returned from hoilday to find my NTK letter form CPM.
I have read the newbies thread, and checked the letter against the PoFA 2012 and everything seems to be in order with it.
Within the newbies thread it says to post a copy of the signage from CPM before making my appeal. My problem is, I dont currently have access to the signage, and, because of my holiday I now only have 8 days to send my appeal to them.
Am I able to use one of the templates provided for my soft appeal to them, or is it highly important that the signs are scrutinised first?

It is better if you have the signs, but do use an appeal to the PPC from a template. Post it up here first and then wait a day for comments. Then make sure you get it in in time.
Having read the sticky (thank you) you will know to write as keeper and avoid specifying who the driver is.

It will be important to know what the sign says before POPLA - but we have seen enough of them to know that they purport to charge a contractual fee but use the word 'unauthorised'. And am I right they use the term 'contravention' and 'breach of contract' on the NTK?
If so I would go heavily on the no GPEOL in this stage of appeal (strangely enough not so easy to rely upon at POPLA stage, where lesnmandy lost a POPLA appeal which is currently the subject of a POPLA complaint). I would try to draw out from them what the breach is about, what loss was caused - and quote the NTK (contravention and breach) and the sign (unauthorised) even though you don't know the sign really did say that. Don't forget to write as the KEEPER only.
To understand all this, have a look at threads by lesnmandy and kennethwilliams101.* The former lost (wrongly!) but the latter in an earlier case, won on 'no GPEOL' because the assessor had a good look at the wording of the same sort of sign and decided on it himself even though it wasn't really raised in the appeal! Very inconsistent.
At POPLA stage please take your time and get our feedback as you will need a strongly worded POPLA appeal - even though lesnmandy's was! You need words that will give the Assessor a virtual slap in the face and show them the sign/NTK is clearly describing a BREACH.
* I will not link the threads here as you need to use the 'search this forum' heading next to 'forum tools' (above the threads on page one of this parking forum) to get the hang of how the forum works for you to research stuff easily. Easy links don't help newbies, IMHO. I have just posted on Detoxs' thread, as when I looked at his photos it is undoubtedly the same car park, so I now know what the signs say.
I have managed to contact a friend in the area who will send me a picture to confirm it, but that is defiantly the same car park0 -
And you're right Coupon-mad it does say "alleged contravention". I have found the relevant post, as well as a few others. I will have a good read of them and go from there.

Actually, c-m, slightly off topic (sorry) I have mused about suggesting that you insert a secret word in your NEWBIES thread and then getting the regulars to agree not to post comments or help unless newbie quotes secret word in their thread.
That would ensure that they read the thread, but obviously the word would need to change occasionally so they don't copy it from an old thread!0 -
