PPI upheld by FOS but rejected by credit car issuer

Hello,

I have a claim with HFC bank which after 20 months has been upheld by the FOS. I finally thought this would be over and i can look forward to a payment. It now looks like i could be another 20 months till anything is sorted!!

Apparently the credit card company has rejected the FOS decision and i now have to wait to have the claim looked at again by the FOS.

I talked to the FOS and apparently an ombudsman doesn't actually get to look at the claim till it has been rejected twice by the credit card company.

Is this right???

It means that HFC dont agree with the adjudicator and have appealed to an ombudsman.

There is no reason to think that the FOS would be telling lies on this.

I fully understood what was happening, i was just looking for feedback from others.

It seems like the majority of people on here are getting there claims upheld with no messing about from the credit card companies, that's all.

In your earlier post you seemed unsure what FOS told you was correct. Others experience is of no use to you here, as every complaint is individual to the customer.
If the Bank have appealed FOS's initial decision then they clearly feel you have a weak complaint. However, the Ombudsman will not overturn the original adjudicator's arbitration unless it is clearly flawed.

You'll just have to be patient.

That is not the case. The overall rate of success on all PPI complaints runs around 60-70%. The last full year reported by the FOS had it at 65%. However, different types of PPI have different success rates. Loan PPI has a very high success rate. Credit card is lower and MPPI is the lowest.

It is unusual for a firm to appeal an adjudicator decision. Not unheard of. Some adjudicators decisions are flawed and they need an appeal.
