What I would like to know is, if the Banks, loans companies etc are at fault in all this and they have broken the law, then why is it up to the individual to reclaim what is rightly theirs.
If these institutions are in the wrong shouldn't they be compelled to return these illegal payments back to the customers ?

PPI is not a legal issue. Not every PPI policy was mis-sold. No laws have actually been broken. Nothing is "Rightly yours" unless you can show the PPI was mis-sold to you (if it was).

They are not illegal.
A unacceptably high proportion were mis-sold by some of the banks. However, not all were and with some types of PPI, only a minority were mis-sold. So, the onus is on the individual to make a complaint if they felt they were mis-sold.I am an Independent Financial Adviser (IFA). I think you've misunderstood what its all about. No all PPI was mis-sold, however it was commonly mis-sold across the board. If you feel its mis-sold then make a complaint. Like already said its not a legal issue and not rightfully yours.0
