Is it 3 years or six years time limit to make a personal injury claim after a car accident please.


Someone has just contacted me to say he has my name as a witness to something that happened 5 years ago, I have no memory of this and Im sure if I witnessed it I would have remembered it. He says someone is making a claim against him for personal injuries and he is desperate for some help.


I want to help but this time limit is the only way I can help him.

Three for injury or I think with children up to their 21st birthday and six for damage.

Injury claims are limited to 3 years from the date of knowing but this is simply for the issuing of proceedings. If there are complex medical issues then the case can roll on for many more years before a settlement is reached or a judgement given.

For car accidents you generally know you have been in them straight away and so the clock starts ticking immediately however for minors the date of knowing is their 18th birthday, someone with a serious mental illness would be the date that they are "better" etc

For some industrial accidents then the date of knowing may be many years in the future before you know that exposure to chemicals have caused cancer etc
