House Floor Tiles

I am after some advice please regarding a tile order from Tile Giant.

I recently purchased some tiles from Tile Giant (140ish tiles, around 1.2 tonnes in weight). When I purchased the tiles they I took in a quote I received a few weeks prior. They could not find this on the system so they created a new order and I paid for them. As Tile Giant doesn’t deliver they said I could pick them up, or arrange for my builder to.

Due to the amount of tiles we were receiving we left them at Tile Giant until Friday, the same day the tile fitter was due. My builder picked up the tiles Friday and they were all ready to lay them on the underfloor heating mats. (which has been newly installed) By chance when I spoke to my builder on the phone that morning and asked what they were like and after he described them I found out they had ordered the wrong colour (light grey instead of the charcoal grey).

To cut a long story short, after wasting the whole day trying to get them replaced, I was told they are only available from one of their distribution sites in Northampton. After progressing this to the area manager I was advised we could not have the new ones until Tuesday, this was due to getting a van to deliver them. After usng my initiative I suggested using an external delivery company and even suggested that I could hire a van and drive to Northampton to pick them up. All of these ideas failed due them saying I would not be insured if I went on site.

I then spoke to the Regional Manager who advised that it clearly states in there T & C’s that I should not have booked a tiler until I had checked the 1.2 tonne of tiles. I have checked their website and it only states the following under the online terms are under late delivery:

Tile Giant will not under any circumstances entertain any financial demands from the customer for late or incorrect delivery. We always recommend that you never book a tiler or other workman until the goods have been delivered and inspected.

This totally goes against the terms on the receipt in which it states ‘We recommend that you do not book anyone to fit your tiles until we have confirmed they are ready to collect from the store’ – They confirmed this 3 times. I ordered them in store so would not have seen the online terms.

Can anyone advise where I stand in charges incurred for the tiler and compensation for loss of time? Also I have been told our tiler is now busy for the next 2 weeks, So that’s 2 weeks I have with treading on the underfloor heading mats due to their error.

    Would also check every tile after delivery. I bought 15 boxes of floor tiles (18 sq mtrs 165 tiles) after opening every box I found 22 tiles broken, mostly in half, which left insufficient tiles to complete the job. Whilst I accept that there are often breakages which should be allowed for 22 out of 165 is too many especially as there was nowhere where the broken tiles could be used. Give them their due B&Q replaced the tiles without hesitation but having to stop the job for the sake of checking every tile would have been inconvenient to say the least.
