Online Store Delivered Without Payment

Hi there guys,

Very new to all this but need some help clearing this up.

I ordered 2 pieces of furniture from an online store with my debit card on the 6th January. The delivery date was booked and I noticed payment was not taken, I read their terms and info and it informed me that they would always take payment on day of or before delivery. This never happened. It has now been 6 weeks.

The thing is now that I thought they must have taken it before and now don't have the money available, I could probably stretch to find this money but it will affect me with my bills etc.

I was wondering how long until they can't take it or until it's kind of written off as it is their error and I'm getting quite worried. I heard 3 months but then I heard 6 years!

Anyone that can give any kind of info would really help me.

  • 6 months without notice, beyond that they can request payment for up to 6 years but should notify you first.

    As above, they could take it out at any time within 6 months without telling you and it will just go.

    I thought 6 years was more for finance situations, not with paying out right through debit cards.
  • No a card auth is good for 6 months. After that they have to re-auth and notify you.

    If you refuse, they'd be able to take you to court as it's a debt, you owe them for the furniture you've got.

    So as it's so recent I'd make sure the money is there. Did you not realise you had a lot more money this month? Or did you just hope they'd forgotten? So spent it?

    I didn't realise as they took the money when I first made the order then it was put back in the same day I was paid.

    It's all to do with the statute of limitations which is six years (5 in Scotland). It just means that even though you still owe the money they can't take you to court for it, but if you owe someone money, you will always owe them money.

    The debt doesn't just dissapear but it's whether you want to do the right thing or not.
