Hairdresser rights question

Hi there
Just wondering what my rights, if any, in the following situation:
Had a hair colour, cut and blow dry. During the drying my eyes were closed due to the hair blowing around. It was a shock to get a hit on the top of my head and the hairdryer in my face. I accept the drop of the hairdryer was an accident, however my head did hurt and I checked it for bleeding as it stung quite a bit. I suspect the edge of the blower end hit my head.
The owner came and joked how she has had several near misses herself but has managed to catch the hairdryer. At the time I smiled along as to be frank I was feeling a bit taken aback (due to disability I don't take well to hits to the head).
Anyway I was not asked how I was, nor was my head checked. I thought it would settle in the next half hour or so. I paid the full price (not thinking straight). Unfortunately it kept smarting and when I mentioned it to others they were shocked I was still charged and that no one checked up on me.
My query is round the fact that I would have thought if a customer is physically hit on the head, an accident report should be done- what do others think? If that had happened and they at least asked how I was I would have probably been able to reflect and articulate how sore it was. I'm sure an ice pack would at least have stopped the lump coming up so much/reduced this soreness 7 hours later.
I did pop back when I could, 2 hours later to say I was not happy with not being asked how I was, not checked and that an ice pack would have probably helped. Family could feel a lump on my head.
I would have negotiated something then if I could. The owner was not interested in my issue, only the fact that my husband had tried to resolve the issue for me. I left saying I no longer wanted to be a customer - hard as this was the only hairdresser that could deliver what I wanted! I'm just shocked at the owners attitude & no attempt to listen to my concerns.

Don't worry about it. Sounds like the injury is probably fatal so you would never get to spend the compo anyway.0

As there doesn't seem to be any lasting injury i would say to forget it and move on. It was an accident.
When you say you could have "negotiated something then" what do you mean exactly ? Why didn't you speak up at the time ?0 -
Did you actually tell them at the time that you were hurt? It sounds like they did not realise that were. If you feel it is sufficiently serious you should go to the hospital.0

Well reading the above I can see why the manager took the attitude and approach she did, I am certainly voting with my feet!
Didn't bring it up above as didn't think it was relevant but since someone asked why I didn't raise the issue at the time : I'm profoundly deaf so communication is a problem. Being deaf I don't have access to English everyday like hearing people and it is therefore my second language. Hairdressers do tend to adapt but there are struggles both ways in communication. I also have an impaired vestibular-ocular reflex so with any fall or hit on the head I tend to get disorientated. This is not their responsibility- it's a fact of my life- the resulting headache is the issue. Really only posted on here as others I talked to felt I should have had a discount (mostly full refund was mentioned!).
After reading the above and being a complete newbie on here, I now see the range of attitudes that people take. I'd appreciate empowerment on when we should speak up about 'accidents'. Surely lots of things happen when we are consumers that can be referred to as human error or accidental? Obviously I'm not able to get into discussions face to face fluently without barriers on both sides hence the use of this forum with family supporting me a bit on the English!0 -

Do you want the technical legal answer? If so, you may be liable for damages due to personal injury as per Kemp and Kemp. In your case, damages would be greater than a normal 'hit on the head' incident as this has a greater effect on you due to your condition (in legal terms, the thin skull rule). However the hairdresser may have a valid defence that you didn't make her aware of your condition before the haircut.
However, the realistic answer is that you've paid in full and left. It's not worth stewing over now, you aren't going to get anything, and best to chalk it up as a funny story to tell others.0 -
Hi, sorry that you got hit! It's happened to me before and isn't the nicest thing.
It might be worth writing a letter to the manager, expressing your disappointment that no-one checked that you were okay.
Don't ask for any money back, just alert them to the fact that you were hit on the head and it affected you, and you didn't feel they noticed enough.
You never know, it might help them in the future with someone else
