Can winning PPI annul my CCJ on that account?

[FONT=Calibri, Verdana, Helvetica, Arial]I got into debt some years ago and defaulted on several credit cards and loans. I came to arrangement to freeze interest and pay in installments and have been clearing debts since. Many were sold by the banks/credit card companies to debt collecting companies.

One in particular was sold on to LINK financial. They, unlike anyone else, took me to court and got a CCJ registered against me against my house.

Since then I have been unable to get any credit, have not been able to move my mortgage or phone contract to get better deals, cannot finance things. I cannot get loans. I’ve made use of pay day loans and credit unions until I got on my feet. The CCJ has cost me money in terms of not switching to better deals and having to use high interest money lending on occasion.

I have just won my case against MBNA for PPI on that account. They did not recall the debt from Link, but sent me a cheque for £1065.

So my question is, if the bill that LINK went to court with was incorrect, can I have the CCJ awarded to LINK annulled and removed from my credit file? The CCJ was put against me for an incorrect amount. As I have paid off a lot of the debt now, by the time I put the £1065 towards the outstanding amount, I won’t owe much and can probably pay it off completely straight away.

Would I be within my rights to get the CCJ removed and previous credit file info amended? Can I claim anything else due to the problems having a CCJ has caused me?

Anyone had any similar experience?

    You still owe something beyond the PPI payout amount so even if they hadn't "missold" you PPI, you would still owe a debt for which they could obtain a CCJ.

    So I don't think you have any chance of getting this removed, and you absolutely have no chance of claiming any money for the difficulties the (valid) CCJ has caused you.

  • But the debt would have been for a much reduced amount that I could have met their repayment requirements on, or even perhaps have paid off, so they wouldn't have had to get a CCJ.
  • Link had every right to get the CCJ against you - you defaulted on the terms of the agreement and as a result have faced the consequences. You have no chance whatsoever in getting the judgment set aside.


    The best you can do is pay it off and then get it marked as satisfied. It is not LINKS fault that you cannot get finance - it is your own.


    You should take responsibility for your own actions instead of blaming others.


    I presume it has been made into a Charging Order is you say its registered against your house? Pay it off !! Then you might be able to remortgage.

    op you only reclaimed ppi which you know you signed up for, due to the chase ppi band
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
