I assume that if I pay for a small claim and they pay up, then I do not get the initial fee back?
Is it only if it goes to court would I get a refund?
Also what do they get - do they have a CCJ on their file - or is that only if it goes to court, or not at all?
How can they pay when they won't know you sent a letter before action, or court papers were served as neither you nor the court know her current address.
Sending to the last known address as suggested by a previous poster, will probably mean they will be returned "Addressee no longer at this address".If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -
If the mail is forwarded or not returned then I (& I assume the court) would assume that the papers had been served?0

Hopefully I am correct in my assumption

Even if you get the CCJ, how do you expect to collect the money?0

Technicality but ... HE won't get the CCJ. If he wins a small claims court case then the other party will be ordered to pay. If THEY don't pay (e.g. within 28 days) then THEY get a CCJ.0
