Can I claim back under section 75?

I booked a coach weekend away but yesterday started being I'll with norovirus and couldn't travel today. I paid on a Tesco credit card. Can I claim the money back? The total cost was £102 which included a credit card charge of 2.5%.

    No you can't.

    The card would protect you against any failure by the retailer.
    In this case there is no failure by them to provide the service (presumably the coach weekend is still on offer?).

    For illness you should take travel isurance.
    Did you take travel insurance for this trip? Do you have any bundled with your bank account?
    Did they sell you any with the trip? Did you take it or decline it?

    If not then I'm afraid you lose your money because the retailer did nothing wrong here.

    It's a shame you couldn't have offered it to a friend but maybe you were so ill you couldn't get to the keyboard.

    Since section 75 covers 'misrepresentation' and/or 'breach of contract', making the credit card provider jointly and severally liable with the retailer, which do you think would give you the best chance of success here?...and why?
  • OP - did you pay any premium to cover against illness prior to taking the holiday - if not do you have any travel insurance linked to your bank account? If no I am afraid you will have to take the loss.
