Executors didnt finish the job, wont answer letters, any advice

Hi all,

found out last week a relatives executors havent finished the job, tax may not have been sorted, dont know about debts, a house was sold but share certificates havent been sorted, the executors wont answer letters, probate registry wont answer phone, so starting to research 'what next'.

a. Do i need to visit the probate registry in Leeds and can i get details of the grant or will?, do i need the executors permission? is there an online registry?

b. Do i go to the local county court to ask for the executors to be 'sacked' and can i be an executor, im the son in law of the deceased,

c. this probate is 15 plus years old, the executors lied about the estate being in order, is this unusual?

thanks in advance for your thoughts

Assuming probate was actually granted you can buy a copy of the grant/will from the Probate Office for (I think) £6

What is your interest in the estate? Are you a beneficiary?

Is the estate actually a trust? If so some of what you say might not be untoward.

As son in law I don't think you are entitled to be an executor - and if things really are as you fear you wouldn't want to be anyway. Too much work for no reward

Are you saying the death was over 15 years ago?
  • yes, death was 15 plus years ago, there is a significant amount in shares we cant access as the executors are only allowed to release them,

You need to check that probate was applied for and granted if not then you need to find out who the executors are and ask why. If you then feel you dont get a decent response you need to apply to have them removed

  • hi all,

sent off to Leeds probate office for copy of grant and will, £6

received the paperwork form from the probate office to apply for inventory and account, all seems straight forward, if the executors dont show does anyone know what happens then?

sent off for a copy of the death cert 'just in case'

to clarify, we have details of accounts possibly with value and shares that have generated funds we cant access as we are not the executors,

is it unusual for executors just to 'not bother'?
