We would like to advise that as per the Car Policy (attached and found on the Just Drive quoting site) for the Salary Sacrifice scheme via Centrica advises you that all fines and charges received by Centrica for your car would be recovered via your net pay to include an admin fee + VAT. Unfortunately the car lease handbook does not advise that we will contact you in the event of a fine received.

It does NOT clarify the matter and you MUST object and refuse the deduction. Insist on escalating this as a grievance - why are the lease co treating a private invoice which is the remit of the driver (for the want of one letter) as if it was a real penalty charge from an authority (Police or Council only)? Ask, why are this clueless lease ignoring the guidance from the Trade Body the BVRLA which has stated for over a year that they should pass the driver's name and address to the PPC, in oirder to simply ensure ZERO liability for them in one fell swoop? All they need is a template letter available from the BVRLA. And the BVRLA has now come to an agreement with the BPA: that PPCs will only ask for driver details (not sure from which date):

You seem to misunderstand why we have seized on the word 'fine' - the reason being this is NOT one - so the lease co. had no business to pay it! They are not liable if they simply pass the driver's name and address on, then it becomes yours to appeal. That's what should have happened. Ask your Fleet Manager for a copy of all the letters, first of all, as part of your grievance as you may be able to complain to the BPA if the Notice was misleading about the lease co's liability. You need to see everything to make an informed decision but make it clear this was not the right response following POFA2012.
