How can i sue eBay?

ok, Long story short!
eBay owe me £115 which is from a payment protection claim, they say that they sent me a cheque for the amount (a year or two ago) but i have NEVER received it. When i asked them for proof, they said it was IMPOSSIBLE to look back at anything over a year old. I mean, come on!
After which they told me they're not going to reply to me anymore and they haven't! I've sent a final letter before court action to this address..
eBay Europe S.à r.l.
15, rue Notre Dame
L-2240 Luxembourg
But, now i don't know how to go forwards, i want to use the small claims court but i don't think i can use it for a head office which isn't based in the UK? Can anyone help?

Good luck with the suing... although I imagine it will cost you more in legal costs than the amount you want back... and no guarantee of success.
Out of interest...
When did they tell you they'd sent a cheque?
When did you chase your refund? My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
Is this the same problem you posted about last year or a new one?

Hi Soolin,
Yes same problem, i sent the final letter to the wrong address, eBay changed it, so i resent 2 more to the address above.
I'm really looking to see if anyone can tell me if the online small claims court can help?
To the first reply, i chased continously over the period of a year before they told me they had sent the cheque 8 months earlier, the customer service has been apalling. Since when did companies think it was ok to not reply to customer queries!? the issue is obviously still open. The Number One Reason for the Success of the Internet

Well I know at that time I had a completely different opinion to everyone else so you will probably want others to respond rather than me. However I would suggest that if you are going to spend money persuing this you really really need to get your time line sorted out otherwise the courts won't listen to you.
In the original thread (and I think I'll merge them to save you having to explain it all again) you say this occured in 2003 which does not tie in with the 'one or two years ' ago now being mentioned.
I can see from your post that you have made contact again with ebay, but what else has been done in the 7 1/2 months since the last thread?I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
