Barclay marked "payments are up to 6 months late" for 16 months

Hi,
I had a Barclay Card from 2004 which I maintained well till end of 2009. Due to some financial problem, I was not able to cope with the payment so went for DMP. I even could not pay the agreed amount on DMP from January 2012. So, Barclay started marking the account to CRAs.
Now, eventually I fully paid the total debt on August 2013 but never noticed that Barclay has been marking it as 6 payments late for 16 months. I have asked for SAR which they have provided. After going through some other posts. I have sent them a letter saying that it is against the ICO's guild line.
In my letter, I have told them that they can not default me otherwise I will go to court as they deliberately did not default after the first 6 missed payments me to keep the account live.
I need advise on the direction as I want them to completely remove the account from CRAs. This is my aim of the complaint to them.
Your expert advise needed please! Any hope in it?

I would disagree, the OP obviously defaulted at some point. They didn't meet the minimum payments. Whether that was at the point of DMP or failing to abide to the DMP they did default at one of those two points and monthly 6 markers would be inappropriate.
Personally I believe it should have defaulted when the OP entered the DMP but as always YMMV0 -
They should have defaulted you within 6 months of the first missed/less than minimum payment.
That is the only basis for your complaint. If they refuse, refer to FOS.
Barclays are well known on here for this.
You have no chance of getting the default removed in my opinion.:beer:0 -
