Audi UK trying to charge me for private parking tickets.

Dear Audi,
Re: Demand for alleged unpaid parking charges of £350, in respect of your courtesy car <Reg No>.
Further to my telephone conversation with <name>, on <date> I deny any liability for these charges for the following reasons-
1. I believe that the contract between us only refers to my liability for fixed penalties and fines (ie from the police, councils or other public authority) and not to private parking charges. If you believe otherwise then please forward me a copy of the signed contract highlighting the relevant terms.
2. Under the Protection of Freedoms Act, Schedule 4, you should have discharged any liability you might have had by naming me as the hirer of the vehicle at the relevant time. The parking company would then have written to me and I would have dealt with the alleged charges. Put simply, it would have been very easy for you to have made this my problem, not yours.
3. Notwithstanding the above, I dispute the charges and will vigorously defend any action taken to try and recover them from me.

You might want to add a friendly (not patronising) paragraph of your own about being happy with their service (if you were) and saying something about POFA being quite recent legislation which you have only just been made aware of so their mistake might be understandable.

So audi have replied and this is what they've sent me.
They state that theyve sent me a 'loan car form' but no contract or T&Cs.
Please advise.

'I acknowloedge your e-mail dated february 12th 2014.
To explain, we have a selection of cars that we make available for our customers to use, some of which are owned by Audi UK themselves, of which the car you had use of was in fact owned by Audi UK. The process they adopt is to pay the fine and charge the centre responsible for that car.
So we have had the money taken from our bank (sum of £320 plus £30 admin charge as detailed on the loan car form) and have no way of obtain a refund.
We have spoken to audi UK and explained your sentiments and they have rejected your statement.
I enclose copies of the parking charges and the loan car form.
Whilst I do understand your fustrations, I must make it clear that I will expect payment in full within the next seven days; otherwise we will pass onto our legal department for recovery.'0 -
They cannot act outside their own terms an conditions, to do so is a breach, and if they do charge your card, get it reversed by the bank as an unauthorised payment. If they won't then send a letter before claim to Audi saying that you will issue against them for the money, plus costsWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Maybe the garage now need to issue a claim against Audi UK. But that's their problem.
Do not pay a penny. And find another dealership next time you need as courtesy car, as I doubt that garage will want to lend you one again.

Car loans and hire agreements are also covered under the Consumer Credit Act - they are obliged to send full terms and conditions. After a formal complaint is made - follow this up with the Financial Obudsman.
And as per advice above - contact your bank for this unauthorised payment requesting they reinstate it.0 -
Luckily they don't have my card details, or I'm sure they would have already tried to charge me.
So where do I go from here people? Another robust reply back?0 -
