If lucky you would only have an argument if it were a day or 2 and can blame the postal system.0

I'm certain there are plenty of examples where FOS have relaxed the referral time (with good reason, I expect) just as there will be a similar number where FOS have applied the time limit rigorously.You are factually incorrect.
